Terms of Use
Scaler offers personalized subscription services that grant users access to enterprise resource planning tools, streamline processes, and manage key metrics. Scaler also provides consulting services to optimize business operations. The service is provided by Computools LLC and governed by these Terms of Use. "You" refers to the user with a Scaler account and active payment method.
1. Subscription
1.1. A Scaler ERP subscription is valid until its expiration. To use Scaler ERP, you need an internet connection, a compatible device, and a valid payment method. “Payment Method” means a current, valid and acceptable method of payment. It may be updated from time to time and may include payment through your user account opened with a third party. If you don’t cancel before the renewal date, you authorize us to charge the subscription fee for the next period using your payment method.
1.2. We can offer you a number of subscription plans. Specific details of the Scaler ERP subscription can be found at support@scalererp.com.
1.3. Costs for accessing and using the telecommunications network are born by the client in accordance with the conditions established by the access providers and the client’s telecommunications operators.
2. Trial Period
We may offer a trial period for new users. The trial’s duration and features will be specified at sign-up. After the trial ends, your subscription will automatically convert to a paid plan unless canceled before the trial expires. Users can cancel at any time during the trial to avoid charges. Only one trial is allowed per user, and we reserve the right to modify or terminate trial offers at any time.
3. Promotional Offers
Scaler ERP may occasionally provide special offers, plans, or subscriptions (“Offers”). Eligibility is determined solely by Scaler ERP, and we may revoke the Offer if you don’t qualify. We may use your device ID, payment method, or account email to assess eligibility. Details on eligibility and other terms will be provided when you register for the Offer.
4. Payment and cancellation
4.1. Payment Period
Your Scaler ERP subscription fee, along with any applicable taxes or transaction fees, will be charged to your specified payment method on the payment date listed in your Account section. The payment period is based on the subscription plan you selected. The payment date may change if your payment method fails, if you change your plan, or if your subscription starts on a date outside the specified month. If you signed up for Scaler ERP through a third party, you can find payment details in your account with that third party.
4.2. Payment methods
In order to use the Scaler ERP service, you must provide a payment method. You authorize us to charge your payment method. You are responsible for any unpaid amounts. If a payment fails due to expiration, insufficient funds or otherwise, and you do not cancel your account, we reserve the right to block your access to the service until we successfully charge your valid payment method. For some payment methods, payment processes may charge additional fees, such as cross-border fees or other fees related to the processing of your payment method. Local taxes may vary depending on the payment method used. Please contact your payment method provider for details.
4.3 Updating Payment Methods
You can update your payment method on the Account page. By accepting updates, you authorize us to continue charging the updated payment method.
4.4 Cancellation
You may cancel your Scaler ERP subscription at any time, and you will continue to have access to the Scaler ERP services until the end of the billing period. To the extent permitted by applicable law, payments are non-refundable and we will not issue refunds or credits for any partially unused portions of your subscription. If you cancel your subscription, your account will automatically be closed at the end of the current billing period. If you subscribed to Scaler ERP through your account, provided a third party as your payment method, and wish to cancel your subscription to Scaler ERP, you will need to do so through that third party, such as by visiting your account with that third party and Scaler ERP services through the third party.
4.5 Changes in Prices and Plans
We may adjust subscription plans and prices periodically. You’ll be notified of any changes at least one month in advance. If you do not accept the changes, you can cancel your subscription before they take effect.
5. Scaler service
5.1. You must be at least 16 years old or of legal age in your region to use Scaler ERP. Minors may use the service only with adult supervision.
5.2. You acknowledge that it has the skills and resources necessary to access and use Scaler ERP.
5.3. The Scaler ERP Service is for personal use only. Your subscription grants you a limited, non-exclusive, non-transferable right to access the service, with no rights, titles, or interests granted.
5.4.The Scaler ERP service is regularly updated, and you can get the opportunity to use new additional features.
5.5. Scaler ERP does not endorse or sponsor the advertised products or services and is not responsible for your interactions with advertisers, including interactions with interactive advertising.
5.6. You will need to download the latest version of Acrobat Reader to read the PDF file. Note: This software can only be downloaded from a website other than Scaler ERP.
5.7. You agree to use the Scaler ERP Service in compliance with all applicable laws and restrictions. You must not:
(i) Alter or bypass any protections on the Scaler ERP Service, including its interface, copyrights, or trademarks;
(ii) Decompile or reverse-engineer any software or products within the service;
(iii) Inject code or manipulate the service’s content;
(iv) Upload or distribute material that harms or disrupts software or hardware, including viruses.
We may terminate or restrict your access if you violate these terms or use the service fraudulently.
5.8. Scaler ERP software, developed by Computools LLC, is designed to provide access to enterprise resource planning, systematize processes, control key metrics, and offer consulting services to optimize business operations. Its functionality may vary depending on the device and platform. Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the software for personal, non-commercial purposes only. Any unauthorized use, reproduction, distribution, or modification of the software is strictly prohibited and may result in legal action. The use of Scaler ERP may require third-party applications, which are licensed from other providers. By using the service, you agree to receive information about updates and automatically install them for both Scaler ERP and any related third-party software.
6. Passwords and account access
You are responsible for all activities that occur under your Scaler ERP account. If you allow others to access your account (which includes access to your account browsing history), you agree that those people are acting on your behalf and that you consent to any changes they may make to the account, including but not limited to changing your subscription plan. You agree to provide and maintain accurate account information, including a valid email address so that we can send you account-related notifications. We may cancel or block your account for your safety, the safety of Scaler ERP or our partners to prevent identity theft or other fraudulent activity.
7. Warranties and Liability
7.1. The Scaler service is provided “as is,” without warranties or guarantees. It may have interruptions or errors. You waive any right to claim damages from us about this. This does not affect your rights under mandatory consumer protection laws in your country.
7.2. To the extent permitted by law Scaler shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use or inability to use the service. In no event will Scaler’s total liability exceed the amount you paid, if any, for access to the service in the twelve months preceding the claim.
7.3. Scaler cannot be held liable for matters outside its control or for any damage that may be caused by the user’s technical environment, in particular computers, software programs, network equipment, and any other devices used to gain access to or use the service and/or the information.
8. Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND SCALER ERP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY AS AN INDIVIDUAL MEMBER, AND NOT AS A PLAINTIFF OR MEMBER IN ANY CLASS OR COLLECTIVE ACTION. Further, to the extent permitted by applicable law, a court may not consolidate a proceeding brought by you with more than one proceeding brought by a third party, nor may a court hear a class or collective action.
9. Other Provisions
9.1 Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the United States.
9.2. Scaler ERP Help Center
For service information or account assistance, visit the Scaler ERP Help Center. If there is any inconsistency between these Terms of Use and information provided by customer support or elsewhere on our websites, these Terms of Use shall control.
9.3. Effect of individual provisions
If any provision of the Terms of Use is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in effect.
9.4. Changes to the Terms of Use and Assignment
Scaler ERP may change these Terms of Use from time to time. In the event of material changes, we will notify you at least one month before they come into effect. If you do not wish to accept such changes, you may cancel your subscription before the changes come into effect. We have the right to assign or transfer our rights and obligations under the contract with you at any time, and you agree to cooperate with us in the framework of such assignment or transfer.
9.5. Electronic Communications
We will send account-related information (e.g., payment authorizations, invoices, changes, notifications) only electronically, to the email address you provided during registration.
